eDiscovery, called e-disclosure in the English courts and sometimes electronic data discovery, is the process of identifying, preserving, collecting, processing, reviewing and producing electronic documents for litigation, arbitration or an investigation. These guides explain each stage in plain English and show how it is run under CPR Practice Direction 57AD.

Use them to scope a disclosure exercise, brief a client on cost and timing, choose between keyword searching and technology assisted review, work out how Microsoft 365 and mobile data fit in, and understand what a defensible production looks like when the other side or the court tests it.

§ What these guides cover

  • What eDiscovery is and how it maps to English disclosure
  • The EDRM stages from identification to production
  • eDiscovery on Microsoft 365, Teams and mobile data
  • How eDiscovery services are scoped, priced and staffed
  • Choosing between keyword search and technology assisted review
